On 30 August 2013, over 10 policemen arrested Kittithon at his house and accused him of posting Lèse Majesté messages on web board of Internet Freedom website under alias name Kenji. He was remanded at the Bangkok Remand Prison on the same day.

 

Throughout the trial Kittithon was always remanded in custody. On 12 December 2013 the Criminal Court found Kittithon guilty in three different counts, 2 counts for committed offense against Lèse Majesté law together with the Computer-related crime Act. Another count he was found guilty for attempting to commit Lèse Majesté offense by having doctored portrait files of the king with abuse message in his computer but the photo hasn't been upload on the internet yet. The Court sentenced Kitthithon to 5 years and 20 months in total.

 

On 8 August 2016, Royal Gazette published Royal Pardon Decree of 2016. Kittithon qualified to be release prior to his actual prison term, he was released from the Bangkok Remand Prison on 7 September 2016 after served 1105 days in prison.   

 

The interesting issue about the case against Kittithon is that it is the first case have ever record, where the court sentence a person for an attempt to commit Lèse Majesté offense.

Kitithon originally from Samut Prakan Province. When he was charged, Kittithon was 51 years old. He ran a whole sale business.

Allegation

On 1 and 2 August 2013, Kittithon replied 2 comments on webboard of Internet Freedom website. His replied messages deemed to be offenses against lèse-majesté law and against the section 14 (2) and (3) of the Computer-related Crime Act.

Moreover, the authorities also found files of photo and messages that deemed to be lèse-majesté offense in Kittithon's computer. Kittithon then also charged for attemp to committ lèse-majesté offense.   

Circumstance of Arrest

30 August 2013

Kittithon was arrested at his house in Samut Prakan Province. At the time of his arrest, over ten policemen and almost 20 Police vehicles showed up at his house. While he was arrested, Kittithon is logging on webboard of Internet Freedom website under alias name “Kenji”. Kittithon was accused for violated the article 112 of the Criminal Code. He confessed his guilt in the investigation stage; he was detained at the Bangkok Remand Prison later on.
