รัฐธรรมนูญมาตรา 153 วรรคสอง กำหนดว่า หากมีการยุบสภาและมีการเลือกตั้งใหม่ สำหรับกฎหมายที่ค้างพิจารณาอยู่ในรัฐสภาที่แล้วนั้น รัฐบาลใหม่ที่ได้รับการเลือกตั้งต้องร้องขอต่อรัฐสภาใหม่ภายในหกสิบวัน เพื่อให้นำกฎหมายที่ค้างพิจารณาจากสภาที่แล้วมาพิจารณาต่อ หากรัฐบาลใหม่ไม่ร้องขอให้นำกฎหมายฉบับใดขึ้นมาพิจารณาต่อ กฎหมายฉบับนั้นก็จะเป็นอันตกไป 

รัฐธรรมนูญ มาตรา 163 กำหนดให้สิทธิประชาชนในการเข้าชื่อกันหนึ่งหมื่นชื่อเพื่อเสนอกฎหมายให้รัฐสภาพิจารณาได้ และกำหนดด้วยว่ากฎหมายที่จะเสนอได้นั้นต้องเป็นกฎหมายตามที่กำหนดในหมวด 3 และหมวด 5 ของรัฐธรรมนูญ

หมวด 5 คือ หมวดแนวนโยบายพื้นฐานแห่งรัฐ

รัฐธรรมนูญแห่งราชอาณาจักรไทย ฉบับ พ.ศ.2550 มาตรา 142 ได้ระบุถึงสิทธิของประชาชนในการเข้าชื่อกัน 10,000 ชื่อ เพื่อเสนอกฎหมายระดับพระราชบัญญัิติให้รัฐสภาพิจารณาได้
